1. Acceptance of Terms

By accessing or using the platform hosted at optimyzer.me (the "Service"), operated by Optimized Performance Solutions, LLC, a Hawaii limited liability company doing business as OPTIMYZER ("Company", "we", "us", "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Not Financial Advice

Optimized Performance Solutions, LLC is a technology, analytics, and software execution provider. We are not a registered broker-dealer, investment advisor, commodity trading advisor, or financial planner. The market intelligence, AI confluence models, Gamma Exposure (GEX) analytics, and automated execution webhooks provided by the Service are for informational, educational, and technological utility only. All trades executed through the platform are completely self-directed. You alone assume full responsibility for your trading decisions and resulting financial outcomes.

3. API Credentials & Security

The Service allows you to connect third-party brokerage accounts (e.g., Robinhood, Tradier) via user-provided API keys. You are solely responsible for maintaining the confidentiality of your API keys and webhook tokens. While Optimized Performance Solutions, LLC utilizes enterprise-grade Fernet AES-256 encryption to protect your credentials at rest, we assume no liability for unauthorized access, erroneous executions, or financial loss resulting from compromised user accounts or third-party broker outages.

4. Subscriptions & Billing

Access to live execution and premium intelligence tiers requires a paid subscription. Subscriptions automatically renew on a monthly basis unless canceled prior to your billing date. All payments are securely processed through our authorized payment partner, Stripe. Refunds for partial-month usage are not provided, though Optimized Performance Solutions, LLC reserves the right to grant exceptions at its sole discretion.

5. Limitation of Liability & Governing Law

In no event shall Optimized Performance Solutions, LLC, nor its members, managers, officers, employees, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law principles.
